Nullification: The Sovereign State's Answer to Federal Tyranny
The Supremacy Clause does not give unchecked power to DC!
Rational thinking needs to be exercised during these tumultuous times that we live in. Most of the harmful legislation that gets passed in congress is the result of a knee jerk reaction to an issue and/or an event. Gun control is a great example of this, as we see a shooting or shootings we feel like we need to do “something” This feeling of urgency that our elected officials get is, in my own opinion, disingenuous at best, completely dishonest at worst. I don’t give these crooks in DC the benefit of the doubt here by dismissing these overreaches of power as acts of good intent. They know what they are doing. They use crises as an excuse to strip away individual liberty from the American people. As Rahm Emanuel once said, “Never let a good crisis go to waste”. People are easy to control when they are scared because they don’t think, they only react to the fear. Overloading the system is the name of the game, ala the Cloward/Piven strategy. Create chaos, overload the welfare system, and make people dependent on the government for life’s basic needs, i.e. HUD, BLM, FDA, HHS, CDC, and USDA. They already have agencies that regulate and control these basic needs that we all have. Bill Gates is buying large chunks of farmland, the supply chain is wrecked, Energy prices are skyrocketing, and all of this is intentional, as the federal government is destroying the economy, on purpose to create this dependency on government.
How do we fight this? The answer lies in the 10th amendment and the sovereign states. Yes that is right, sovereign states. But what about the so called supremacy clause? Doesn’t federal law always trump state law? The supremacy clause is invoked by the leftists when their fascists are the ones running the show. Obey or else. But, put the shoe on the other foot and have a Trump type figure in charge and they invoke the 10th amendment saying that as a state, they can do what they want to do. The Marxists currently in charge, use the constitution when it helps their narrative, but scream “living, breathing document” when referring to the constitution, in cases where they want to change our founding document to fit their twisted logic.
So when do we recognize federal law, and when do the states have to obligation to ignore unconstitutional federal law, AKA, nullification? Let’s first look at what we refer to as the supremacy clause, Article VI Paragraph 2 “This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.”
The key here is “Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States” This means that laws that are made and follow guidelines in this supreme law of the land, supersede state law, but if congress is acting outside of its enumerated authority that is very specifically laid out in Article I Section 8 regarding congressional authority, then said law endorsed by the congress is not “in pursuance thereof” the supreme law of the land as it goes outside constitutional parameters. Nowhere in the constitution is there a mention of limiting the actions or rights of the individual citizen. The constitution exists solely to put restrictions on government authority, hence creating maximum individual liberty without government interference. So the so called, supremacy clause only applies when congress is acting within its assigned constitutional boundaries.
Thomas Jefferson and James Madison, established the basis for nullification with the Kentucky and Virginia Resolutions of 1798. Jefferson referred to nullification as “the rightful remedy” to usurpation of unconstitutional authority by the federal government. Madison went a step further by asserting that a state is “duty bound” to act in order to “to arrest the progress of the evil”. Nullification was utilized to force Parliament to repeal the Stamp Act. George Nicholas of Virginia said that if congress exercised authority that was not specifically given to that body, that Virginia would be “exonerated from it”. This was recognizing the states’ legal authority to block implementation of federal law in similar instances where congress went too far and acted extra-constitutionally. James Madison details how to go about this in Federalist # 46.
So how does this apply to modern times? This really emphasizes the importance of your local and state elections. If you want to be protected from tyranny at the federal level, look first to your local Sheriff, then to you Governor. If the Governor of you state refuses to play ball with Uncle Sam, then you will be shielded from the federal overreach. Federal law enforcement does not have the resources or manpower to enforce most of the federal law on the books now, if everyone chose to ignore them. They count on compliance. Your obedience is required for them to take your right to life, liberty, property, and the pursuit of happiness. We can use this constitutional tool of nullification is we hold our elected officials’ feet to the fire and force accountability to the constitution by electing representatives that actually constitutionally educated and understand the importance of adhering to its principles. Biden can only control us if we let him. He does not have the consent of the governed. States like Florida and Texas will be fine. California, New York, Illinois, Washington, Oregon, and the like are going to allow themselves to be controlled by the feds, and they will be at the mercy of the “dementia patient in chief” himself, Joseph Robinette Biden.
John Adam's stated that "Our Constitution was made only for a moral and religious People. It is wholly inadequate to the government of any other" and is this not our issue? It could be great again but not for a people like what our society is dealing with.
