Red Flag Laws Circumvent Due Process in the Name of “Safety”
The age of, “guilty until proven innocent” is upon us
There is now a bipartisan gun control agreement in the US Senate with 10 Republican Senators on board. Those 10 Republicans must be named, and I will do it here. John Cornyn (TX), Thom Tillis and Richard Burr (NC), Roy Blunt (MO), Bill Cassidy (LA), Susan Collins (ME), Lindsey Graham (SC), Rob Portman (OH), Mitt Romney (UT) and Pat Toomey (PA). There are several components of this proposed bill, but I want to focus specifically on the red flag laws that have been proposed. These laws have already been implemented in multiple states. These are nothing but feel-good laws that are pushed through to make the self-righteous people in positions of power feel like they are doing “something” and that they are the saving grace that is needed to keep people safe. Bottom line here, is that you cannot legislate evil away. No piece of legislation is going to keep evil people from doing evil things no matter how broad.
Let’s talk about some problems with red flag law mentality. First of all, from a constitutional standpoint, red flag law is basically gun confiscation in the absence of due process. This means that if someone tips off the government, you know, “see something say something”, you are then deemed guilty until proven innocent. Yes, your guns are taken away until you prove your innocence. A judge is responsible for making this decision and as we all know our judiciary has given us reason to be concerned about the abuse of authority that has been wielded by the courts in recent years. Using the gun debate as a pretext for revoking constitutional rights in the name of “safety”, is reprehensible. There was always going to be pretext to justify the tyranny. There was always going to be a reason for the power grab, and the Marxists are masterful at tugging on peoples’ emotions as a catalyst for their destructive policy ideas.
Allowing the courts to decide who needs to have their 2nd Amendment rights revoked because Joe Blow down the street says that they heard them say this or that, and that may suggest the person in question is capable of x, y or z. We are all individuals, and no two people are alike. Different experiences, how someone is raised, home life during their impressionable years, one parent, two parents, same sex parents, all of these and relevant genetic predispositions have a role in establishing how an individual will react to their surroundings, and how they process the data that is acquired from the situational awareness that they may or may not have. This is why having an algorithm, or “warning signs” is not going to be an effective way to predict things to come. We are diving into a “Minority Report” dystopian nightmare, where the government could arbitrarily decide who gets to keep guns, and what individuals are not mentally stable enough to be armed.
An armed society is a polite society. What has kept us going as a country all these years? One could argue it is the 2ndAmendment that has allowed us to keep our individual liberty intact. Let’s look at the history of gun control on a global scale since the early 20th century. Let’s start with Ottoman Turkey, 1915-1917 1-1.5 million Armenians (mostly Christians) were killed under the enforcement of Art.165, Pen. Code, 1866 & 1911 Proclamation 1915. In this instance permits were required of gun owners, creating a registry of those holding weapons, and eventually a ban on possession.
Fast forward to Soviet Union, 1929-1945, here political opponents and farming communities were targeted, resulting in 20 million being killed, via Resolutions, 1918 Decree, July 12, 1920, Art.59 and 182, Pen Code, 1926. This began with licensing of gun owners, then went to banning possession, withsevere penalties for violations.
Nazi Germany and Occupied Europe, 1933-1945, 20 million Political opponents, Jews, gypsies, and critics were killed under the Law on Firearms and Ammun., 1928 Weapon Law, March 18, 1938, and Regulations against Jews, 1938. Registration and licensing, stricter handgun laws and ban on possession were some of the features of these Nazi firearms restrictions.
This continues into the 20th century in China 1927-1949 (10 million killed), then again in China throughout the 50’s, 60’s and 70’s (20-35 million killed), Guatemala 1960-1981 (100,000 to 200,000 killed), Uganda 1971-1979 (300,000 killed), Cambodia 1975-1979 (2 million killed), and Rwanda 1994 (800,000) killed.
More recently, Venezuela went from being the wealthiest country in South America, to being a socialist nightmare where people are starving and utilizing their own pets for food as basic necessities are inaccessible. In 1992 Venezuela was the 3rd richest country in the Western Hemisphere. In 2001, Venezuela voted for a Socialist President to address “income inequality”. In 2004, their private healthcare system is completely socialized. In 2007, all higher education was made “free”. Come 2009, the Socialist government banned private gun ownership. In 2014, Political opponents are imprisoned. In 2016, food shortages become commonplace and widespread. In 2017, Constitution and elections are suspended. Then in 2019 the people were being massacred by their own military under orders from the socialist dictator, living in luxury while his people suffer. It only took that long for a prosperous country to be reduced to a third world hell on earth. This was ultimately made possible by preventing the masses from defending themselves from a tyrant.
Gun bans/confiscation always ends the same way, mass genocide. You give them red flag laws now, and they will have the bureaucracy residing in the alphabet soup agencies to take the rest of our freedom. The 2nd Amendment is non-negotiable. “SHALL NOT BE INFRINGED”! Seems pretty clear to me. Gun Control? Hell NO!
